Terms of Service

1. Services Provided

Organizer provides professional home organizing services; creating simple, functional, sustainable systems.  Services may include but are not limited to:

  • In-home consultations 

  • In-person organizing may include but are not limited to:

    • Pantries

    • Closets

    • Bedrooms

    • Playrooms

    • Laundry rooms

    • Bathrooms

    • Home offices

    • Garages

    • Small store-front businesses

  • Decluttering + edit services

  • Post-move unpacking services 

  • Light styling for functionality

Organizer is not a moving company. Services do not include heavy lifting, furniture moving, junk hauling, deep cleaning, or repairs unless specifically agreed to in writing.

Specific Services for Client’s project will be outlined in a Proposal. If Client wishes to change the scope of the Services, Client shall advise Organizer, and such changes shall be agreed upon both parties by email. 

Organizer shall perform the Services in a workpersonlike manner and shall provide at Organizer’s expense all labor, transportation, insurance, and services necessary to complete the Services.  Organizer shall not subcontract any Services to be provided under this Agreement.

2. Client Responsibilities

Client agrees:

  • To provide safe and reasonable access to the home during scheduled sessions;

  • To be present or available for decision-making unless otherwise agreed;

  • To disclose fragile items, valuables, pets, allergies, or unsafe conditions;

  • To make final decisions regarding what to keep, donate, or discard; and

  • Organizer is not responsible for decisions made by Client during or after sessions.

3. Fees & Payment

In full and complete consideration for performing the Services and Organizer’s other obligations under this Agreement, Services are billed at a flat project rate as agreed outlined in the attached Proposal.  A deposit of 50% will be collected at time of booking. Additional hours may be required to complete projects and are billed $85 per additional hour. 

Minimum booking for organizing or decluttering: 4 hours

Minimum booking for post-move unpacking: 6 hours

Client will be provided an invoice, with payment due at the end of each session, per the agreed payment schedule as outlined in the attached Proposal. 

Accepted payment methods: Credit/Debit card.

Late payments will result in suspension of Services until outstanding payments are paid in full.

4. Travel Fees

For locations outside the South Charlotte area, a travel fee may apply and will be outlined in the Proposal.

5. Cancellations & Rescheduling

Client must provide at least 24 hours’ notice to cancel or reschedule.

Cancellations or requests to reschedule with less than 24 hours’ notice will be charged 50% of the scheduled session fee.  For flat rate projects, the scheduled session fee will be calculated by dividing the project rate by the number of planned sessions to complete the Services.  Any rescheduling fee will be charged in addition to the fees for the Services performed.  

No-shows are subject to full session charges.

6. Supplies & Purchases

The purchase of organizing products (bins, containers, shelving, etc.) are not included unless agreed upon in advance.  Organizer will not purchase items on Client’s behalf without prior approval.

7. Limitation of Liability

Client understands and agrees that:

  • Organizer is not responsible for pre-existing damage.

  • Organizer is not liable for damage caused by Client or any third parties not affiliated with Organizer.

  • Organizer is not responsible for loss or damage to items discarded or donated with Client’s approval.

  • Client releases Organizer from any claims related to property damage, personal injury, or dissatisfaction arising from Services, except in cases of gross negligence.

8. Safety & Injury

Organizer reserves the right to stop work if conditions are unsafe, in Organizer’s sole discretion (including but not limited to aggressive pets or people, hazardous materials, or unsanitary conditions).

If Organizer must stop work due to unsafe conditions, Client will be charged for Services already performed, and may be charged a fee equivalent to a full session if Organizer is unable to immediately reschedule. Client’s recurring refusal to remedy unsafe conditions may result in termination of this Agreement by Organizer.

Client shall be liable for any injuries or damage sustained by Organizer if directly or proximally caused by Client, Client’s property, or Client’s guests on Client’s property.  Client assumes responsibility for their own safety during sessions and agrees not to hold Organizer liable for injuries sustained on the premises by Client or any third parties other than Organizer.

9. Confidentiality

Organizer agrees to keep Client’s personal information and details about Client’s home and personal belongings confidential and will not disclose such information without Client’s consent, except as required by law.

10. Photographs & Videos

 Organizer may take photographs and/or videos (collectively, the “Images”) of Client’s space before, during, and after Services are rendered for internal documentation and quality purposes. Organizer shall have complete ownership of the Images, including copyright interests, and Client acknowledges that they have no interest or ownership in the Images or their copyrights. 

Select Images may be used for Organizer’s marketing, promotional, educational, and portfolio purposes, including but not limited to Organizer’s website, social media platforms, digital marketing, and printed materials.

Client understands that all Images will be used with care and discretion. No identifying personal information (including names, addresses, or faces) will be disclosed unless explicitly authorized in writing by Client under separate cover.

Client will not receive financial compensation for such use of the Images. Client hereby releases, discharges, and holds harmless Organizer from any claims, demands, or causes of action arising out of or related to the use of the Images.

11. Independent Contractor Relationship

Organizer agrees to perform the services hereunder solely as an independent contractor.  Client and Organizer recognize that this Agreement does not create any actual, implied, or apparent agency, partnership, franchise, or relationship of employer and employee between the parties.  Organizer is in no way whatsoever authorized to enter into or commit Client to any agreements.  Organizer shall not represent itself as Client’s agent or legal representative at any time. 

Organizer agrees and understands that Organizer is entirely responsible for any state, federal, local, or Social Security tax liabilities or any other insurance or cost which may be incurred or earned as result of this Agreement.  Client shall not be liable for any taxes, or unemployment, health, dental, liability, Worker’s Compensation (unless required by law), or other type of insurance for or on behalf of Organizer. 

12. Termination

Either party may terminate this Agreement with at least 15 days written notice. Upon notice of termination of this Agreement, Organizer shall immediately cease performance of any additional Services other than to perform those Services and any service deliverables required for the orderly close out of the Agreement.  Client shall pay for all actual costs, including time spent by Organizer, incurred to complete activities associated with the termination and close out.

Neither party shall be liable or deemed to be in default for any delay or failure in performance under this Agreement resulting from causes beyond the control of such party.

13. Insurance

Refresh and Reclaim Rooms LLC is a professional, insured business. Proof of insurance is available upon request.

14. Changes to Term

We reserve the right to update these Terms of Service at any time. Updates will be posted on this page with a revised effective date.
